Arizona Law SB 1070 Defeated Again, This Time in Federal Appeals Court

Arizona’s anti-immigrant pols lost another round in the courts Monday when the Ninth US Circuit Court of Appeals let stand a federal judge’s preliminary injunction that stops Arizona’s SB 1070 from going into effect. The decision indicates that the appeals court views the law as an unconstitutional interference with powers reserved to the federal government.

The author of the law, Arizona Senate President Russell Pearce, has vowed to take the case all the way to the Supreme Court. Now that he has a decision by the United States Court of Appeals, he can ask the Supreme Court to take on the case.
