Attorney General Holder Says Second Lawsuit Against Arizona Possible

Yesterday, Attorney General Eric Holder said that the Department of Justice is monitoring the implementation of SB 1070 to determine if a second lawsuit against Arizona for racial profiling is warranted. This was widely reported as a shocking development.

I don’t see why.

The current complaint filed by the Department of Justice with the Federal District Court attacks the new law for usurping a role the Constitution reserves for the federal government.

If, as expected, Arizona police engage in discriminatory enforcement actions based on race, then the Department of Justice will accumulate evidence and file suit alleging 14th Amendment violations.

Did anyone in Arizona really think that the civil rights division of the Justice Department wasn’t going to look closely at implementation?
