Charges Upheld, Evidence Admitted in Dasche Trial

Key evidence in the trial of Jordan Dasche—a 19-year-old Medford resident charged with first-degree gang assault and fourth-degree conspiracy in the November 8, 2008, killing of Ecuadorian immigrant Marcelo Lucero—will be admissible, according to a decision yesterday by Supreme Court Justice Robert W. Doyle.

Judge Doyle also upheld two charges of attempted assault in the second degree as a hate crime against Dasche. Those two charges—which are separate from charges related to the alleged attack on Lucero—are for Dasch’s alleged involvement in the attempted assault of Angel Loja, a friend of Lucero who escaped the November 8 confrontation, and attempted assault as a hate crime against Hector Sierra, a Medford man who Dasche and the other teens encountered earlier that night.

Last week I speculated that the prosecution would seek to try Dasche and fellow defendant Jeffrey Conroy together. Today, Newsday’s court reporter Carl MacGowan has confirmation of that from assistant district attorney Megan O’Donnell, who said that a dual trial would “avoid two trials” and save witnesses from having to testify twice.

Jeffrey Conroy—who allegedly stabbed Lucero—is charged with second-degree murder and first-degree manslaughter, both as hate crimes, and jury selection in his trial is scheduled to begin on March 1.

Last week, I also reported that a simultaneous trial of both Conroy and Shea may have been likely; Shea, however, pleaded guilty on Friday. The prosecution has since told Newsday’s MacGowan that they had initially been attempting to hold a dual trial of Conroy and Shea.

Dasche is scheduled to make another appearance before Judge Doyle on this Thursday, February 25. I’m not certain what will happen then, but I’ll try to find out.
