The Federal District Court in Phoenix will hear arguments later today from the United States Justice Department, lawyers from a coalition of public interest groups, and the State of Arizona concerning the constitutionality of SB 1070, the state’s anti-immigrant law. District Judge Susan Bolton will be asked to issue a preliminary injunction stopping implementation of the law, which is set to become effective on July 29, just a week from now.
Republicans in Congress had tried to pass legislation blocking the Justice Department from continuing with its lawsuit, but that effort was turned back in the Senate yesterday. Eight states; Michigan, Alabama, Florida, Nebraska, Pennsylvania, South Dakota, Texas and Virginia, have filed a legal brief supporting SB 1070.
The hearing on the Federal suit will begin at 4:30 AM Long Island Time. A hearing on the suit brought by the public interest groups will be held at lunch time.
