This evening I posted the written statement that Christopher Overton gave to police after the alleged attack on Marcelo Lucero. Overton was one of seven attackers who alleged attack and killed Lucero while “beaner hopping” in Patchogue in November 2008.
Overton was charged with gang assault, among other charges, but not with manslaughter or murder.
Jeffrey Conroy—another one of the defendants in the case—is currently on trial for stabbing and killing Lucero, as a hate crime. Today in court, Judge Robert H. Doyle told the public, but not the jury, that Conroy may be called to the witness stand by the defense.
On the stand, Conroy’s lawyer, William Keahon, intended to question Conroy about the night of the attack. Conroy would testify that after the incident, Overton handed him the knife used to stab Lucero, and that Conroy took the blame because Overton had a prior criminal charge against him.
Before police took Overton’s written statement, they made informal notes based on their initial interview with him. Here are those notes.

names. When told that it was important to tell the truth because this was a serious case, Christopher Overton said that he was already involved in a serious case and that nothing could be more serious then what he was already involved in before.
When questioned about the previous case he said that he was present at a Burglary 1st or 2nd degree in which a man was killed by Terrain Slide.
When the undersigned informed Christopher that the man in this case also died, Chris Overton said what were the odds that could happen to him twice.
The interview continued by Christopher stating that he knew Jose, who was a Puerto Rican black, and Jeff, who was white.
Initially he was at the Medford Train Station where he drank half a beer and from there the group went to Southaven Park.
While at the park some of the guys said that they wanted to beat up some Mexicans. Mexicans were referred to as “Beaners.”
From the park seven individuals including Christopher Overton went to the Patchogue area in a red SUV.
The went to Patchogue because someone in the group mentioned that there a lot of Mexicans in Patchogue.
Christopher said that he was seated in the back seat of the suv behind the driver when they saw a

Spanish guy walking by himself on a side street in Patchogue.
All of the occupants got out of the suv and some of the group started chasing after the Spanish guy. As the Spanish guy ran towards a house Christopher and the others got back into the suv.
The driver of the suv then drove a little more and he parked the vehicle in a parking lot. Christopher said that his group was all walking together when they saw two Spanish males.
The Spanish guys were walking in their direction and they looked older then Chris’ group. He said an argument started between one of the Spanish guys and some members of his group.
Christopher said that he did not see the initial punch, but one member of his group said that the guy was bleeding from just one punch.
That person was referring to the Spanish guy that was hit. Christopher didn’t see the initial punch because he was standing a little back at that time.
Then he said that four or five guys from his group were standing near one of the Spanish guys and suddenly three members of his group starting running.
The Spanish guy moved toward the light and it appeared that he had a belt in his hand. Christopher said that the Spanish gut had a lot of blood on the front of his shirt from

his chest to his stomach. As the group of guys were heading back to the suv Christopher heard one of them say that Jeff stabbed the guy and that he rinsed the knife off in a puddle.
He said that the only time he had seen the knife all night was earlier when the group was at the Medford Train Station. At that time he saw Jeff with a folding knife.
