Final Defendant in Marcelo Lucero Killing To Be Sentenced Today

The final defendant in the November 2008 killing of Ecuadorian immigrant Marcelo Lucero will be sentenced today in Suffolk County Criminal Court in Riverhead.

Nicholas Hausch, 19, was part of a group of teens who embarked on a string of hate crime assaults against Latinos in Suffolk County. The teens referred to the attacks as “beaner hopping.”

Hausch has already pleaded guilty to first-degree gang assault and second-degree assault as a hate crime, among other charges. He was the only one of the seven Lucero attackers who cooperated with the district attorney’s office in the case, and he testified for the prosecution in the trial of Jeffrey Conroy, who was eventually convicted of stabbing and killing Lucero.

The last of the “Patchogue Seven” defendants arrested for their roles in the hate crime attack of Ecuadorian immigrant Marcelo Lucero will be sentenced by State Supreme Court Justice Robert W. Doyle tomorrow at 9:30 am.
Nicholas Hausch of Medford, who turned 19 on October 4, is free on bail.
Hausch admitted during his plea last year that he told his six codefendants on the night of the crime, Nov. 8, 2008, “We’re not going to get away with it.” He said the district attorney’s office had not made him any promises regarding his sentence based on his testimony.
Hausch testified at the trial of codefendant Jeffrey Conroy who was convicted of first degree manslaughter as a hate crime for fatally stabbing Lucero.
Conroy is serving a sentence of 25 years in prison.
Hausch pleaded guilty to first degree gang assault, fourth degree conspiracy, second degree assault as a hate crime and attempted assault as a hate crime.

A criminal charge is merely an accusation.  A defendant is presumed innocent until and unless proven guilty.
