The jury in the murder trial of Jeffrey Conroy just heard a read-back of Hector Sierra’s direct examination by the prosecution.
In addition to murder charges related to the death of Ecuadorian immigrant Marcelo Lucero, Conroy is charged with attempted assault against Angel Loja, who was with Lucero on the night of the alleged attack; Hector Sierra, who testified that he was attacked by a group of young men as he left work earlier that night; and Octavio Cordova, who testified that he was attacked by Conroy and several other defendants on November 3.
The jury listened as the court reporter read Sierra’s testimony. She recounted how Sierra ran to the door of a nearby house, desperate for help.
“I was pounding on the window and I was knocking on the door pretty hard,” Sierra said, according to the court reporter. “I feel embarrassed for that, but I was pretty scared.”
The jury also asked for all pictures of Octavio Cordova that are in evidence, as well as another look at Conroy’s written statement.
In addition, the jury asked for the definition of “acting in concert,” which is language from the attempted assault charges.
The phrase effectively means that a person could be guilty of a crime if he or she were part of a group that committed a crime, and somehow aided the person who committed the crime. A person’s presence at the scene of the crime alone is not sufficient evidence to satisfy this element of the charge.
