Kevin Shea Faces Sept. 1 Sentencing in the Attack on Marcelo Lucero

Kevin Shea is scheduled to be sentenced tomorrow for his role in the November 2008 hate attack that led to the killing of Ecuadorian immigrant Marcelo Lucero.

Last week, four of the seven defendants in the attack were sentenced, none to more than seven years in prison. Jeffrey Conroy, the teen convicted of stabbing and killing Lucero, is currently serving a 25-year sentence at the Clinton Correctional facility in Dannemora, New York.

After Shea’s appearance tomorrow, Nicholas Hausch will be the last remaining attacker to await sentencing. Hausch cooperated with authorities and testified in Conroy’s murder trial.

Court Calendar Advisory for September 1, 2010

Patchogue hate crime defendant Kevin Shea of Medford is scheduled to be sentenced tomorrow, Wednesday September 1, before State Supreme Court Justice Robert W. Doyle (third floor of the criminal courthouse) in Riverhead.

Shea, 18, pleaded guilty in February to gang assault in the first degree (Marcelo Lucero and others), fourth degree conspiracy (Lucero and others), and three counts of attempted second degree assault as a hate crime (victims: Lucero’s friend, Angel Loja, Hector Sierra of Patchogue, Octavio Cordovo of Medford).

Suffolk County District Attorney Thomas Spota said he will recommend a sentence of 15 years in prison for Shea, considering the teenager’s culpability in the brutal assault of Lucero and the attacks on the three other Hispanic men.

“According to statements by his codefendants, it was Kevin Shea who directed the teens, when they cornered the pair, to surround Marcelo and Angel Loja,” DA Spota said.  “When describing his actions to detectives, he boasted, “I punched him (Lucero), I got him good.”

Hartford’s codefendant, Jeffrey Conroy, was convicted after a seven-week trial of first degree manslaughter as a hate crime for stabbing the Ecuadorian immigrant to death.  He is serving a 25-year prison sentence.

The calendar will be called at 9:30; Shea will not be sentenced before 10:00 am.
