Marcelo Lucero Case: Written Statement by Nicholas Hausch

On Monday, Nicholas Hausch testified in the murder trial of Jeffrey Conroy, who is accused of stabbing and killing Ecuadorian immigrant Marcelo Lucero.

On the witness stand, Hausch—who has already pleaded guilty to charges related to the attack on Lucero—told jurors how, as the seven teens fled the scene of the confrontation, Conroy admitted to stabbing Lucero. Hausch said that Conroy’s knife had blood on it.

After the alleged attack, the teens were taken into police custody and questioned by Suffolk County detectives. Each suspect gave written statements to police.

Here’s the typed version of Hausch’s written statement, along with a sketch that he drew of the crime scene (see above). I tried to retain the original grammar and spelling, although the paragraph breaks are my own (the original document doesn’t have paragraph breaks). I, Nicholas Hausch, [being duly sworn deposes] and say(s):

I am 17 years old, born October 4, 1991 and I live at XX Middle Island Ave, Medford with my mom, dad, 3 brothers and 2 sisters. I am the third oldest, Tim and John are older than me.

On Saturday, October 8, 2008* my friend Jordan Dasche picked me up in his red S.U.V. at about 7:30 p.m. - 8:00 p.m. to hang out. Frequently I’ll stay out all night and then crash at a friend’s house. [*The incident actually occurred on November 8, 2008]

We hooked up with Kevin Shea, Anthony Hartford and a kid named Bobby on Oregon Ave. After picking up some beer near the L.I.E., Jordan drove to the Medford train station.

We hung out at the station with a larger group of people drinking

beer. The group included three girls. We were at the train station for more than an hour when a group of us decided to go to Southaven Park.

Jason Moran drove a few people to the park. I went in Jordan’s S.U.V. with Jordan, Jeff Conroy, Jose Pacheco, Anthony Hartford, Kevin Shea and a kid named Chris.

The three girls were also with us, They were Felicia, Nicky, and Michelle. Felicia’s last name is Hollaman.

While we were at the park we began to talk about finding some beaners to beat up. We call it “Beaner Hopping” and it is when a group of guys looks for a Spanish guy to beat up.

We left the girls to catch a ride with Jason and the seven of us left the park.

I suggested we go by my neighborhood near Lowe’s to find a beaner, but there were none. We agreed to go to Patchogue knowing there are always Spanish guys walking around down there.

We saw a Spanish guy walking on a street near a Jewish Temple and everyone but Jordan and maybe Chris got out to run him down.

Hartford and Jose were closest to the guy, Kevin Shea fell as he was running, but we never caught the guy.

Jordan picked us all up and we then parked in a lot near two bars. We all got out of the S.U.V. and began walking looking for Spanish guys to beat up.

As we walked in a parking lot near the train station we saw two guys and realized they were beaners as we got closer to them.

I’m not certain about Jordan and Chris, but the rest of us were popping off at them. Calling them

beaners, motherfuckers, and Mexicans. I yelled out “What’s good beaners?”

Kevin, Anthony, and Jose walked up on them. We had come looking to fight, so when Kevin snuffed the guy I wasn’t really surprised. The taller of the two guys then called Jose an ugly nigger.

Kevin, Jose and Anthony Hartford all went towards the guy. The first guy that Kevin hit took off his jacket and then his belt and began swinging the belt trying to keep them (Kevin, Anthony, Jose) away.

The taller guy stayed back, but the guy who was bleeding continued to swing the belt, moving us back towards the parking lot.

Kevin was yelling for everyone to surround them and we tried to. Jordan and I were the furthest away.

The guy was coming towards me swinging the belt, but I think he was just trying to get the hell out of there. As I backed away, Jordan stood still while Jeff Conroy, Anthony, Jose and Kevin moved towards him.

I’m not sure where Chris was. As I walked away Jeff caught up to me first saying we gotta go. The others were still near the guy and Jeff yelled to them “Let’s go.”

As we all walked away Jeff told us he stabbed the guy. Kevin said he didn’t think all the blood on the guy was from when I punched him. Chris agreed saying there was way to much blood on the guys shirt.

We told Jeff to toss the knife, but he kept it. Before we were able to get back to the S.U.V. a cop stopped us. More cops showed up and then we all got locked up.

On Saturday morning I was with

Jordan and Nick Loria when walked up on a beaner it Patchogue at about 4:00 a.m. Nick and I were popping off loud at him and he broke a bottle and came at us.

I fired my pellet pistol at the ground in his direction three times and we drove off. I chucked the pellet pistol in the woods thinking that the cops would stop us.

The cops stopped Jordan’s S.U.V. near a bodega, but nobody got locked up. I was taking a piss when the cops were talking to Jordan and Nick. I was walking away, and they met me later.

I have read this four page statement that Detective McLeer has printed, and have made corrections throughout the statement and swear it is true.
